LICENSING EXPLAINEDLEASE LICENSE OR EXCLUSIVE PURCHASEThe difference between a Lease and Exclusive Purchase besides the price is the exclusivity. A lease is non-exclusive, meaning it can be temporarily sold to multiple users. An exclusive purchase gives only you rights. There are no prior leases* on exclusive beats, and they're removed from the website. Both licenses give you rights to sell your product. The terms of the license vary from deal to deal, but in the end they serve the same purpose of granting the buyer (licensee) certain rights of use.A lease license is referring to the purchase of temporary rights to distribute and record over a piece of music known as a beat or instrumental. Leasing a beat (or instrumental) gives the artist the right to use that piece of music in compliance with the rights and regulations stated in the lease agreement. Typically, after leasing a beat you can use it for a variety of outlets. For example, online streaming platforms such as Spotify, iTunes, etc. Leasing a beat (or instrumental) may also be used in mixtapes, albums, live performance and radio play. An Exclusive Purchase provides the user with unlimited use, unlimited revenue, unlimited remixes and ownership of the music. If your goal as an artist is longevity, land major label deals, get signed, monetize your music and/or perform live an exclusive license may be best for you. Exclusive beats are ideal for album releases since you will be the only artist in the world with that music. Also, it is easier for record labels to market, sign and distribute artists who create songs exclusively as original music. Exclusivity gives complete freedom to do whatever you like with the beat. A lease license or exclusive purchase is needed in order to use our copyrighted music. This ensures that the producer, TMS B.Ware (licensor), gets properly compensated. All of our music has been copyrighted at the U.S. Copyright Office. The legal penalties for copyright infringement are: Infringer pays the actual dollar amount of damages and profits. The law penalizes infrigement up to $150,000 for each work infringed upon. * An exclusive license may be purchased after it has been leased, as long as the purchaser understands that the beat has been leased prior to the exclusive license purchase, and the prior leased beat is being used until their lease expires. This situation usually happens if the song does blow up, you always have the option to buy exclusive rights to the beat at any time. BASIC LEASE LICENSEThe basic lease will get you access to the high-quality, 320 kbps MP3 version of the beat. The beat will contain one tag "Capital P on the Tracks" during the intro of the beat. The rest of the beat is untagged. You are allowed to import it to your DAW and record vocals over it. Great for demo purposes. Up to 5000 non-monetized video and 5000 audio streams are allowed.Full Basic Lease License Agreement PREMIUM LEASE LICENSEThe premium lease will get you access to the high-quality, 320 kbps MP3 and 32-bit WAV versions of the beat. Each will contain one tag "Capital P on the Tracks" during the intro of the beat. The rest of the beat is untagged. You are allowed to import it to your DAW and record vocals over it. Great for high quality demos for those who do not want track stems, but expect to have larger distribution and streaming exposure. Up to 20,000 non-monetized video and 20,000 audio streams are allowed.Full Premium Lease License Agreement UNLIMITED LEASE LICENSEThe unlimited lease will get you access to both Premium Lease mixed files. You also get access to complete untagged track stems as well as untagged melodic mix 32-bit WAV and 320 kbps MP3. Individual track stems can be loaded into your DAW for complete control over your session. Unlimited distribution, as well as unlimited non-monetized video and unlimited audio streams.Full Unlimited Lease License Agreement "LIMITED" EXCLUSIVE LICENSEA Limited Exclusive purchase is basically an exclusive purchase that have previously been leased. This means that you will own the beat after buying it. Any artists that have previously leased the beat are allowed to use the beat until their lease term expires.When you buy Limited Exclusive beats, you will own full rights of the beats. Also the beats are delivered with contract and all their separated wav stems (track out) files, including untagged, mixed 320 kbps MP3 and 32-bit WAV melodic mix files. Like full exclusives, Limited Exclusive rights grant you unlimited commercial recordings and broadcasts. You have full rights to record, alter, mix the beat/song in any shape, way, or form (except reselling the beat). You will receive a contract granting you exclusive rights to the beat. You own the recording as a "work made for hire". We will no longer lease or sell the beat/song on our promotional page (no listening or downloads there). We will not receive a royalty from sales or downloads. You must however give credit to the seller (TMS B.Ware), "Your Song Name (prod. by TMS B.Ware)" on all recordings. "Limited" Exclusive License Agreement EXCLUSIVE LICENSEExclusive beats or 100% exclusive beats are Sold Only Once and have never been leased. This means that you will be the only artist to own the beats after buying it. When You buy exclusive beats, you will own full rights of the beats. Also the beats are delivered with contract and all their separated wav stems (track out) files, including untagged, mixed 320 kbps MP3 and 32-bit WAV melodic mix files.Exclusive rights grant you unlimited commercial recordings and broadcasts. You have full rights to record, alter, mix the beat/song in any shape, way, or form (except reselling the beat). You will receive a contract granting you exclusive rights to the beat. You own the recording as a "work made for hire". We will no longer lease or sell the beat/song on our promotional page (no downloads there). We will not receive a royalty from sales or downloads.
